Avoiding trouble will only make it worse.

Rain is being called to Hawaii on November 4th 2008. But the trip is not to show off his English skills.

ESL student is being called to testify in front of a federal court for the abrupt cancellation of his concert last year in June 2007. Local promoter, Click Entertainment, is suing Rain and demanding that Rain and his organizers, JYP Entertainment and Star M pay more than 4 million USD for the Aloha Stadium fiasco.

Rain and his previous management have avoided the call to court in Korea. And now faced with a court date in Hawaii., they will likely push to postpone the appearance. If granted, that would buy an extra 2-3 months. But, why postpone? Magic Feet should just be a man and take responsibility for his actions. Because, no matter how you slice it, Rain has to go to court anyways. So a few more months is not going to make the pain any less.

Rain’s current management company, J-tunes is washing their hands of any responsibility.

Last year, Rain also abruptly cancelled his concerts in Atlanta, New York, San Francisco and Los Angeles.

    I think Rain is doing just fine. He’s only pathetic when he tries to speak perfect English with an American accent. Rain, relax…no one expects you to speak like a native American. You wouldn’t want to if you knew most Americans have such vocabulary. Serviceable English is enough. Can a kind soul pass this message to him? He badly needs it if he doesn’t want to make a fool of himself in the West.

    seriously.. when i went to staples center and found that he wasnt going to appear i was like why the f did i even go… and he didnt even come out to apologize.. i was like waiting for people to sue him… gosh i really hated him for doing that and i still hate him…

    It’s because they’re after the money.

    The report said that more than 1 million USD was spent to organize the concert. Yes, maybe that could be 2 million, but that couldn’t be 4 million. THEY’RE JUST AFTER THE MONEY. Just like that band who sued him for the name RAIN.

    Funny also that you said the 2 companies already paid – so, does that mean that they were not responsible? So, you’re saying that if Rain pays up, he’s no longer responsible for it?

    Poor Rain. I wonder if he had any say on whether or not it was to be cancelled.

    It’s wrong to do that to the fans though, especially after they paid and all that “WOOO. I get to see Rain! blah blah blah.”

    supposedly, click-e already sued and got their investment back from jyp and star m. something along the lines of breach of contract, don’t you know. because, you see, click-e put up their own capital to sponsor the concert, in good faith that dRain would actually show up and perform according to their contract.

    but when you have a contract and someone breaks it, shouldn’t someone sue? click-e not only lost out on their initial investment to sponsor the concert in hawaii, but they also lost out on revenue that they could have collected had dRain performed as per the contract.

    of course its all for the money. people don’t go into business to lose money. that would be assinine. but business has to be fair. if you’re under contract to produce something, then you’d better produce it or it’s a breach of contract.

    how do you figure that jyp and star m are no longer responsible and that dRain won’t be responsible once he pays up? if someone settles out of court, or a judgement was awarded to them, then they are admitting their guilt or were found to be responsible.

    now, mind you. dRain hasn’t been convicted of any wrongdoing. Yet. that’s why he needs to show up in hawaii for the court appearance. it would be interesting to see how it all plays out. whether or not the judge in the case will rule in his favor or not.

    get my anti statements straight? i’d say they are. you just don’t understand the legal process.

    Rain is coming to town in November. But the return trip might not be in the type of venue that the K-Pop star envisioned for his Honolulu debut.

    Rain, who had a supporting role in the summer flop Speed Racer, will have to testify in the federal court trial stemming from the abrupt cancelation of his Aloha Stadium concert last year.

    Local promoter, Click Entertainment, is suing Rain, whose real name is Jung Ji-hoon, over the failed concert. U.S. District Judge David Ezra recently ordered Rain’s Korean handlers — JYP Entertainment Co. and Star M Entertainment — to pay Click more than $2 million for the Aloha Stadium fiasco.

    Attorney Eric Seitz, who represents Click, said he deposed Rain in South Korea last year but the singer did not answer any substantial questions.

    It’ll be interesting to see if Rain can dance his way out of questioning this time — especially if he under oath and in front of a seasoned federal judge.

    When he came to Australia, one of my mother’s friends was an organizer or something. The tickets were too high priced for anyone to buy them – especially for some Korean singer than hardly anyone, other than the Koreans, had heard of. And only a fraction of those Koreans actually liked Rain.

    The tickets, in the end, were given out for free after a small amount had been sold. That organizer ended up losing 1.3 million dollars.

    he should just pay it and let it go. he has the money for it. its already a scandal him paying for is not going to make it any bigger than it already is. what is he thinking? if he avoids it everyone will ignore it with him and it will magically disappear? no no rainy it doesnt work that way. i’m sure he is going to put it off especially with his new album coming out in about a month. 2-3 months is all he needs to do promotions and interviews for the new album and make at least two music videos. you can put him down as “pinky” all you want but he isnt a totally idiot. everyone makes mistake and this a HUGE mistake that he is making worse by letting it linger like this. though i love rain to death in the end he is a typical celebrity: deny any responsibility to anything bad to keep a good image no matter what. too bad

    @fyi:Most of the fault goes to StarM

    Isn´t StarM also stockholder with J-tune Entertainment? I thought I read about this fact in the beginning of J-Tune.

    Who were the parties to the “contract” you’re talking about? Isn’t it the management and the buyers? Yeah Rain might have taken part to the breach but he can’t be solely liable for that..

    Generally, due to heavy caseloads the courts have to handle, legal suits have the ability to show up much later, or when u least expect them to.

    I don’t find this old news, I just think it is a continuation of the unresolved and unpleasant business

    I am sitting on the fence this time because I am a fan – though part of me feels he shld refund some money as a gesture of goodwill. A friend concurs.

    I hope the outcome will not set a precedent for other concert promoters to come forward and claim damages from Star M and him. The last thing he needs now (troubled career aside) are more legal suits.

    Ummmmm….isn’t it the fault of JYP and the other management company. I would think Rain wouldn’t have to pay anything since he was not the organizer or manager at the time. By the way, is the CEO of J-Tune really 33 and is marrying a 22 yr old girl? Is that true?

    He is being sued for canceling the concert in the states? But what about the concert he canceled in Toronto, Ontario? I don’t care that much since even if it was free, I wouldn’t have gone. However, I know people who brought tickets for it and I am not even sure if they even got any refund. All I know it was a last minute cancellation for some dumb and illogical reason (that is, if there was any real reasons at all). Well, I guess that is what you get if you annoy fans and those in the entertainment business. If he was smart, he should have gone to court and finish all the papers. The longer he drags it on, the more he has to pay.

    Toronto was canceled due to some stage/fireworks problem [press release].. but others say not enough tickets were sold. And some people still didn’t get their tickets refunded from there (as well for the LA fiasco.. depending which vendor they brought from).

    I’m still awaiting refund on my ticket to his cancelled concert. According to local promotor, ticket money was wired to Star M and when the concert was cancelled, nothing was returned. Despite the claim to “full refunds” on posters, consumers are left with rain-checks [excuse the pun] until the lawsuit is won.

    The name lawsuit was a smokescreen for the ruckus created. They went ahead and sold tickets for an event they were not sure would proceed or not. That constitutes fraud to some. Which has a broad definition.

    The reason/s must be valid enough to cancel that much shows.

    Before they have decided to do the cancellations, i believe they had a lot of thinking for that,weighing the pros & cons. Now the hard part is, the explanation. But as long as it can be well justified, things will be cleared out. Unfortunately, every action has its consequences- Rain is getting much of the weight- ‘coz it is his name that’s on the front line. He & the company ,just have to bear with it though.
    Well, eventually, it will pass and things will go back into normal.
